Copyright Fair Use Clause :
The link refers to the "good faith effort" made by Paul Halsall, author of Byzantine studies on the Internet, "to comply with US Copyright Law" in dealing with copyrighted materials, particularly concerning adherence to the "fair use" clause of US Copyright Law. Likewise, I have tried to make a "good faith effort" in preparing the pages presented here, particularly with regard to the use of Thumbnails and Midi Music Files.
Use of Thumbnails :
Visitors to this site will notice the use of thumbnails particularly in the pages titled Medieval Byzantine Icons and Contemporary Byzantine Icons, in both English and French. "Thumbnails" in this context meaning small low-resolution copies of full-size images shown on other websites and owned by their respective authors. All "thumbnails" shown were generated from downloads of these full-size images using a program called "Easy Thumbnails". Next the thumbnails were inserted in the pages and provided with links to their respective full-size images on the owners' websites. Following this all above mentioned downloads were removed from the author's machine. It might be added that thumbnails were made only as enhancements of links already shown in the text.
The methodology just described fits in with both the "good faith effort" and the "fair use" clause of US Copyright Law. As well, it is supported by the recent US Ninth Circuit Court of Appeals ruling: "The Ninth Circuit Court of Appeals has ruled that making thumbnails of another owner's image and posting it to your site does not infringe on the copyright of the original owner. They did not specify a specific size of a 'thumbnail". Read the Washington Post Article from 2/07/02. (Reported by the New York Times in the first week of June 2002.
Midi Music Files :
Midi Music Files found on the Music Page are either in the public domain or were downloaded with permission of their owners for being made available for your listening pleasure. For further details click these lines to read the method employed to ascertain that the Midi files on this site are in the public domain.

This site renders a service to many people. I am hereby not referring to the visitors who enjoy seeing this site, as I hope they would, and I take this opportunity to thank each visitor for stopping by. This message, however, is addressed in particular to the contemporary living iconographers, icon selling organizations, musea owners... In short, to all owners of images found on this site, copyrighted or not copyrighted.

As previously mentioned, the site renders a service to many image owners because their work is being announced on this site, with links to their sites, free of charge, no strings attached. The service may be all the more valuable in view of the fact that this site enjoys a large and steadily growing number of visitors. Several people personally conveyed this to me. Others, not yet shown on these pages, wrote to me asking if they too could be announced. I have invariably done so, with pleasure, and I will continue to do so, free of charge.

Whereas up to now I almost exclusively worked with small thumbnail images, I recently have taken to showing larger images, also held on my own hard disks, in order to be able to better show the visual and spiritual beauty. Doing so reduces dead links as well. Some of the images in both the image scrollers and in the still image galleries are examples hereof. While these larger images may no longer be considered thumbnails, many of which also aren't my property, they are all linked to their respective owners' sites, and thereby continue to render them a useful service. If the owners' sites are not linked to from the pages with scrolling image galleries, then they are already linked to from the contemporary byzantine icons page (Index-Imagebase).

If an owner of an image has any objection to its use on this site as described, would he or she please contact me. I will remove the image in question pending the outcome of any discussion we may have. Thank you in advance for your understanding and collaboration.
